The Estate Process

When a person dies, someone must take responsibility for administering the final affairs. The general name for someone who performs these tasks is the fiduciary, more commonly referred to as an executor.

The executor must:

  • Gather the assets of the deceased and obtain appraisals as required
  • File an asset inventory in a timely manner
  • Pay any creditors
  • File estate and income tax returns and pay any taxes that are owed
  • Distribute the remaining assets to beneficiaries, if there are any
  • Close the estate by filing a final account or certificate of termination in a timely manner
